These Terms of Service ("Terms") govern your use of the Culivo mobile application ("App") operated by Culivo ("we," "our," or "us"). By downloading, installing, or using the App, you agree to these Terms.

1. Acceptance of Terms

By creating an account or using the App, you confirm that you are at least 13 years of age and agree to be bound by these Terms. If you do not agree, do not use the App.

2. Account Registration

• You must provide accurate and complete information when creating your account.
• You are responsible for maintaining the security of your account credentials.
• You are responsible for all activity that occurs under your account.
• You must notify us immediately of any unauthorized use of your account.

3. Use of the App

Culivo provides AI-powered cooking assistance, recipe management, nutrition scanning, shopping list tools, and related features. You agree to use the App only for its intended purposes and in compliance with all applicable laws.

You agree NOT to:

• Use the App for any unlawful purpose
• Attempt to gain unauthorized access to our systems or other users' accounts
• Interfere with or disrupt the App's functionality
• Reverse engineer, decompile, or disassemble any part of the App
• Use automated systems (bots, scrapers) to access the App
• Upload malicious content or content that infringes on others' rights
• Circumvent usage limits or subscription restrictions

4. AI-Generated Content

Culivo uses artificial intelligence to generate recipes, provide cooking advice, analyze nutrition information, and suggest recipes based on ingredients. You acknowledge that:

• Not medical or nutritional advice: AI-generated nutrition information and dietary suggestions are for informational purposes only and should not be considered professional medical or nutritional advice. Consult a healthcare professional for dietary concerns.
• Accuracy: While we strive for accuracy, AI-generated content may contain errors. Always use your judgment when following recipes, especially regarding food safety, cooking temperatures, and allergen information.
• Allergen warnings: Although Culivo considers your allergy preferences, AI-generated recipes may not catch all potential allergens. Always verify ingredients if you have severe allergies.

5. User Content

You retain ownership of content you create within the App (saved recipes, chat messages, shopping lists). By using the App, you grant us a limited license to process, store, and display your content as necessary to provide the service.

You are solely responsible for any content you submit, including photos sent for AI analysis.

6. Subscriptions & Payments

Free Tier

The App offers a free tier with daily usage limits, including a limited number of AI chat messages, nutrition scans, and recipe image generations per day.

Premium Subscription

• Premium subscriptions provide unlimited access to AI features.
• Subscriptions are billed through the Apple App Store or Google Play Store.
• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period.
• You can manage and cancel subscriptions through your device's app store settings.
• Refunds are handled by the respective app store according to their refund policies.

7. Intellectual Property

The App, including its design, code, features, branding, and AI models, is owned by Culivo and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the App without our written permission.

8. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CULIVO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR DAMAGES ARISING FROM YOUR USE OF THE APP OR RELIANCE ON AI-GENERATED CONTENT, INCLUDING RECIPES, NUTRITION INFORMATION, OR COOKING ADVICE.

10. Termination

We may suspend or terminate your account at any time if you violate these Terms or engage in conduct we determine to be harmful to the App or other users. You may delete your account at any time. Upon termination, your right to use the App ceases immediately.

11. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes through the App or via email. Continued use of the App after changes are posted constitutes acceptance of the revised Terms.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.
